These Terms and Conditions of Sale (the “Terms”) govern all orders and purchases made through www.laparisienneomaha.com (the “Site”), operated by La Parisienne French Bakery LLC, a Nebraska limited liability company doing business as “La Parisienne” (“we,” “us,” or “our”).
By placing an order through the Site, you (“you” or the “Customer”) confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not place an order.
1. Our Products
We sell handcrafted baked goods and related items. Because our products are made by hand, the actual product may vary slightly from the photographs shown on the Site in appearance, size, and decoration. All products are subject to availability and may be modified or discontinued at any time without notice.
2. Pricing
All prices are listed in U.S. dollars (USD) and are exclusive of applicable sales tax unless stated otherwise. We make every effort to display accurate pricing, but errors may occur. If we discover a pricing error on an item you have ordered, we will contact you before fulfilling the order and give you the option to confirm at the corrected price or cancel for a full refund. Prices are subject to change at any time, but changes will not affect orders we have already accepted.
3. Orders and Order Acceptance
Your submission of an order through the Site constitutes an offer to purchase. An order is not accepted until we confirm it (for example, by email confirmation). We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, product unavailability, or errors in pricing or product information. If we cancel an order you have already paid for, we will issue a full refund.
4. Payment
We accept Zelle, Venmo, PayPal, and cash.
- Online payments (Zelle, Venmo, and PayPal) are made at the time the order is placed and are required to confirm the order.
- Cash orders are paid in person at the time of pickup, subject to the conditions in Section 7 below.
- Custom orders and certain larger orders require a deposit to be confirmed — see Section 8.
5. Local Pickup
Orders are fulfilled by local pickup at our location in Omaha, Nebraska. During checkout, you will select an available pickup date from the dates we offer.
- Pickup location: Communicate after ordering
- Pickup hours: Friday, Saturday, and Sunday, from 11:00 a.m. to 2:00 p.m. and from 3:30 p.m. to 5:00 p.m.
- Please bring your order confirmation when collecting your order.
- We will hold your order until the end of pickup hours (5:00 p.m.) on your selected pickup date. If you notify us in advance that you cannot make it, we may hold your order until 5:00 p.m. on the following pickup day.
- Orders not collected within this period may be forfeited without refund. We are not responsible for the quality or condition of perishable items left uncollected beyond your selected pickup date.
6. Changing Your Pickup Date or Time
- Date changes: You may request a change to your pickup date provided you notify us at least 24 hours before your selected pickup date. Date changes are subject to availability.
- Time changes: You may request a change to your pickup time (within our pickup hours) on the day of pickup itself.
To request a change, contact us using the details in Section 16.
7. Cancellations and Refunds
7.1 Prepaid orders (Zelle, Venmo, PayPal)

- More than 48 hours before your selected pickup date: full refund, less any non-refundable payment processing fees.
- Between 48 hours and 6 hours before your selected pickup date: 50% of the order amount is refunded; the remaining 50% is non-refundable.
- Less than 6 hours before pickup, or no-show: no refund.
7.2 Cash orders (paid at pickup)

- If you place a cash order and you fail to pick it up (no-show) or cancel less than 12 hours before your selected pickup date, you will no longer be able to place future orders without paying in advance. In that case, all of your future orders must be prepaid online (Zelle, Venmo, or PayPal).

8. Custom Orders and Larger Orders
Custom orders (such as custom cakes, special-occasion items, or large or bulk orders) and any order over $100 placed through the Site require a non-refundable deposit of 50% of the order total to confirm the order.
- The 50% deposit is non-refundable, including in circumstances where you would otherwise be eligible for a refund under Section 7.
- Any amount paid above the deposit is subject to the cancellation schedule in Section 7.1.
- Final details for custom orders (flavors, design, text, allergens) must be confirmed by you in advance; we are not responsible for errors arising from instructions that were unclear or not provided.
- Custom orders may require additional lead time, as confirmed at the time of order.
9. Allergens and Food Safety
Our products are made in a kitchen that handles common allergens, including wheat/gluten, eggs, dairy, tree nuts, peanuts, and soy. Even where an item does not list a particular allergen as an ingredient, we cannot guarantee that any product is free from cross-contamination and we cannot guarantee an allergen-free product.
It is your responsibility to inform us of any allergies or dietary restrictions before placing an order, and to review any allergen information we provide. If you have a severe allergy, please contact us before ordering. To the extent permitted by law, we are not liable for any reaction resulting from allergens where the relevant information was not disclosed to us in advance.
Our products should be stored and consumed in accordance with any handling and freshness guidance we provide.
10. Sales Tax
We collect Nebraska and applicable local (Omaha) sales tax on taxable items as required by law. Tax is calculated and shown at checkout.
11. Intellectual Property
All content on the Site — including text, logos, product names, images, and designs — is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, or use this content without our prior written permission.
12. Limitation of Liability
To the fullest extent permitted by applicable law, our total liability arising out of or relating to any order or these Terms will not exceed the amount you paid for the order in question. We are not liable for any indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Governing Law
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or your order will be subject to the exclusive jurisdiction of the state and federal courts located in Douglas County, Nebraska.
15. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time you place your order governs that order. The “Last updated” date above indicates when these Terms were most recently revised.
